What is the right of access?

The right of access, commonly referred to as subject access, gives individuals the right to obtain a copy of their personal data as well as other supplementary information.  Individuals have the right to obtain the following:

  • Confirmation that you are processing their personal data;
  • A copy of their personal data; and
  • Other supplementary information – this corresponds to the information that you should provide in a privacy notice. (click here for our Privacy Notice)

The CCG undertakes to endeavour to respond to any Subject Access or Access to Health Records request within 21 days. Under the General Data Protection Regulation (GDPR) there is a requirement to respond within one calendar month of receipt of any request. If it is anticipated that it will take longer than one month to provide a response, where requests are complex or numerous, the applicant will be informed and given an explanation for the delay within the one calendar month.

The timeline commences when the CCG has received a request from an individual and the CCG will need to ensure that ALL of the following are collected as early as possible to meet the required deadline:

  • Valid Identification
  • Payment of a fee if request deemed “manifestly unfounded or excessive”
